Move towards unregistered barristers

The Bar Standards Board (BSB) looks set to introduce ‘unregistered barristers’ who may practice unreserved legal services without a practicing certificate.
Unreserved legal activities are areas of law and legal practice which are currently unregulated, including will writing and employment advice.
A consultation will propose that barristers without a practicing certificate who offers such legal services must get written confirmation from their clients, whether individuals or businesses, that the barrister has explained his status and what the consequences could be, for example, the absence of insurance.
The move by the BSB reflects the fact that there is an increasing number of lawyers including barristers who are undertaking unreserved legal activities and that the public require better protection.
