  • The Institute of Legal Executives is in the process of applying for the right to grant powers for legal executives to make grants of probate, meaning legal executives and will writers could perform the grant of probate.

  • Currently, only solicitors and licensed conveyancers are permitted to do so.

    ILEX has made the application to the Legal Services Board (LSB) to allow its members to make grants of probate, and also to allow non-ILEX members including will writers to grant probate rights.  Under existing rules, will writers’ activities are unregulated.

    ILEX chief executive Diane Burleigh said: “ILEX has had a long-term goal to provide greater career opportunities for our members, and to give clients a wider choice of lawyer.”

    If the application to the LSB is successful, legal executives wishing to take on such work will be required to pass an exam at honours degree level in probate and succession, and show knowledge of equity and trusts.  A spokesperson for ILEX says the qualifications required by ILEX will be at least as demanding as for solicitors.
