Why do people always leave things until the last minute?
All About Law. | 20.05.2010It is so frustrating – I had to spend nearly an entire day (a few weeks ago) on a case where a couple had defaulted on their loan (which they had secured against their property) and has been reminded, on a regular basis, to make payments for the last three months.
I was then instructed to issue proceedings and a Court date was received for a Thursday in April and only on the Monday of that week did the clients start panicking that they were going to lose their house! Most of the day was tied up speaking with the loan company I am instructed by and the borrowers credit management agent to see what they could realistically afford etc. In between dealing with tearful phone calls from the borrowers themselves! Thankfully an agreement regarding a lower monthly payment amount was agreed by all concerned which meant that the Court hearing had to be vacated. If only the borrowers had contacted us earlier a lot of work, stress and costs could have been saved!
From now on I will be making a conscious effort to remind the various borrowers I am instructed to chase, how important it is to keep the lines of communication open between themselves and either us or the loan company directly and how much stress it will save them (and us) as if they leave it to late Court Hearings will go ahead and then they are at risk of losing their house!
So apart from the stress of the above I seem to have spent the remainder of my time doing the normal admin, filing and reminding clients of things I am waiting for…yes I know what will happen everything will come in at once! I have to say that already this week I am starting to see things coming in, hopefully it will mean that I can finish some of the older files off now.
On a separate note - I don’t know whether anyone else has found this but the Revenue appear to be looking more and more closely at Probate files – we have had two now where we had almost completed the matter and had applied for clearance and the Revenue have raised further queries – one on personal chattels sold at auction and the other on investments where we were claiming IHT relief. It appears that they are trying to get as much tax paid as possible! I have a few new IHT accounts going into the Revenue soon so I will be keeping an eye on any issues which the Revenue raise – an interesting time to say the least!- Comments
