The christmas backlog…
All About Law. | 21.01.2010A bizarre start to the year with all that snow which has been great for new claims but seems to have meant that insurers have struggled to deal with post and so I have found that the incoming post and cheques are only just getting back to normal.
- As ever in our business, developments are afoot with the release of the Jackson report last week. It seems to me that there is little in the report that can actually be taken out and used on it's own. For instance, could you stop ATE in our RTA cases without the cost shifting that has been suggested or the uptake of more BTE? Can you abolish the indemnity principle without all the other aspects being in place?I don't think so but as with every other commentator on the subject, the devil is in the detail, and there is a lot of detail! The one aspect that I forsee being taken on it's own is the abolition of referral fees or at the very least a reduction to £200. I'm no expert on this but if they get rid of them, or reduce them, then they will just go underground in some form or another and this cannot be good for clients.I know that if I wasn't in the industry and didn't know that some type of fee was being paid, then I would feel misinformed and cheated that things to do with my case were not being told to me. In which case all the bad press about PI claims would be back on the agenda. Don't get me wrong, I don't like them but at least an informed decision is far better than having these things hidden in some form of fee.The new claims process is just around the corner and I keep hearing little snipets that make this slightly more complicated than first seems. Such as not getting paid any aspect of your fees until the conclusion on infant cases and £250 of the £500 stage three fees being for the advocate. It will be interesting to see how this finally pans out.On a personal note, I'm chairing a credit hire conference in London on 23rd February for CLT so if you fancy coming I'd love to see you and there are some really interesting speakers booked.
